Utilities Regulation and Development
Our experience here includes serving as counsel to a wide variety of water utility providers, including cities, counties, public facilities boards, non-profit rural water associations and others. Our projects range from structuring financing for expansions, to structuring debt offerings, to guiding clients through condemnation proceedings. Not only do we use applicable law to protect rural water providers from municipal encroachment, we also use it to solve concerns over the efficient growth of Arkansas communities.
In recent years, the Firm has done much work representing vendors, lenders and building owners in the development, maintenance and financing of energy conservation measures. In many of these cases, the cost of upgrades is offset by the energy savings realized. We’ve helped municipalities, school districts, government agencies and private developer’s structure lease agreements for equipment, allowing these costs to be expensed as opposed to being a liability on the balance sheet. In fact, we’ve presented numerous speeches around the country on this subject.
